An easement is a legal right allowing someone else to use part of property for a specific purpose, like utilities, drainage, access, or maintenance.
In HOA communities, easements are one of the biggest reasons owners discover they cannot build exactly where they expected.
Common HOA easement examples
- Utility lines running along a side yard
- Drainage easements behind fences
- Association access for maintenance
- Shared driveway or pathway access
Why it matters
You might own the lot and still face real limits on where a fence, shed, patio, tree, or pool can go.
Before you build: Check the plat, survey, CC&Rs, and any design-review requirements. Easement problems often appear after work starts, when fixing them gets expensive.
