Arizona HOA Rental Restrictions: What Owners Should Check
Arizona owners often ask some version of: can my HOA stop me from renting my house? The answer is rarely simple. Rental disputes usually depend on the exact declaration language, any amendment history, lease-term requirements, occupancy limits, and whether the restriction targets short-term rentals or all leasing.
Questions to check first
- Does the declaration expressly restrict rentals?
- Is there a minimum lease term?
- Was the rule added later by amendment or only by board policy?
- Does the rule target short-term stays, tenant screening, or rental caps?
Why this is such a high-friction issue
Owners often buy expecting flexibility. Boards often react to investor concentration or short-term-rental concerns. That makes the wording and amendment history incredibly important.
Big distinction: a board preference about rentals is not the same thing as a valid recorded restriction.
Check the rental restriction language
Upload your documents and ask “Do my CC&Rs actually restrict leasing or short-term rentals?”
