What Are HOA CC&Rs?
CC&Rs stands for Covenants, Conditions, and Restrictions. In plain English, they are usually the main recorded rulebook for what owners can do with their property inside the HOA.
They commonly cover leasing restrictions, architectural changes, easements, maintenance duties, assessments, parking limits, nuisance rules, and enforcement power.
Why homeowners should care
If the board says you cannot paint your home, rent it short-term, park an RV, or build a fence, the first place to look is usually the CC&Rs. They often carry more weight than a later board policy.
Where CC&Rs show up in real life
- Violation letters
- Architectural approval disputes
- Rental and occupancy restrictions
- Assessment and maintenance obligations
Shortcut: If the HOA cannot point to a written restriction in the CC&Rs, bylaws, rules, or a valid amendment, the argument usually gets weaker fast.
What question to ask next
Ask: “What exact CC&R section are you relying on?” Then compare that language with any rules or guidelines the HOA is citing.
