How to Write a Dispute Letter to Your HOA
An HOA fine landed in your mailbox and you know it's wrong. Or at least questionable. The single most effective thing you can do right now is write a formal dispute letter. Not an angry email. Not a phone call. A written letter that cites specific documents and statutes. Here's exactly how to write one.
Why a written letter matters
Phone calls disappear. Conversations at board meetings get remembered differently by everyone. A written dispute letter creates a paper trail that protects you at every stage. If the dispute escalates to a hearing, mediation, or court, your letter is evidence that you raised the issue formally, on time, and with specifics.
Most CC&Rs also require disputes to be submitted in writing. If you call the management company to complain but never put it in writing, you may lose your right to appeal.
The five things every dispute letter needs
1. Reference the specific violation notice. Start by identifying what you're responding to. Include the date of the notice, the violation number if one was assigned, and the specific rule they're citing. This prevents the board from claiming they don't know which violation you're referring to.
2. State your position clearly. In one or two sentences, say whether you're disputing the violation entirely, acknowledging it but disputing the fine amount, or requesting a hearing. Don't bury the point in a long story.
3. Cite the governing documents. This is the part that gives your letter teeth. If the rule they're citing doesn't exist in the CC&Rs, say so and reference the section where it should be. If the fine exceeds what the fine schedule allows, cite the schedule. If they skipped the cure period, cite the section that requires one. Specific section numbers make your letter credible and hard to dismiss.
4. Cite the applicable state statute. If your state has an HOA act that requires notice, a cure period, or a hearing before fines are valid, reference it. A board that realizes you know the state law is far less likely to push the issue.
5. State what you want. End with a clear request. "I request that this fine be rescinded." or "I request a hearing as provided under Section X of the CC&Rs and [State Statute]." Don't leave them guessing what resolution you're seeking.
A framework you can follow
Common mistakes to avoid
Don't be emotional. "This is unfair and you people are ruining our neighborhood" might be true, but it won't get your fine reversed. Stick to facts, documents, and statutes. The more clinical your letter sounds, the more seriously it gets taken.
Don't threaten to sue in the first letter. Mentioning litigation immediately puts the board on the defensive and often makes them less willing to negotiate. Save that for round two if the dispute isn't resolved.
Don't ignore deadlines. Many CC&Rs have time limits for filing disputes or requesting hearings, sometimes as short as 10 days from the date of the notice. Check your documents and respond within the deadline even if your letter isn't perfect. You can always follow up with additional details.
Don't skip the hearing. If you're offered a hearing, attend it. Bring a printed copy of your dispute letter, the relevant CC&R sections, and any photos or documentation that supports your position. Boards are far more likely to waive or reduce a fine when the homeowner shows up prepared than when they just send an angry letter and never follow up.
Finding the right sections to cite
The hardest part of writing a dispute letter is finding the exact clause in your CC&Rs. These documents are 80+ pages of cross-referenced legalese. You need to find both the rule they're citing against you and the enforcement procedures section that says how fines must be handled.
A good dispute letter doesn't need to be long. It needs to be specific. When you can say "Section 8.3(b) requires a 14-day cure period, which was not provided" instead of "I wasn't given enough time," you transform a complaint into a legal argument. That's the difference between a fine that sticks and one that gets thrown out.
